Welcome to GlobyClassifieds. By accessing or using our website (the "Platform") and purchasing any pricing plans for ad publication, you agree to comply with and be bound by the following Terms & Conditions. If you do not agree to these terms, you must not use our services.

1. Services & Pricing Plans

GlobyClassifieds provides a digital platform for users to publish classified advertisements. Users may purchase pricing plans that grant the right to post a certain number of ads or access premium features for a defined period (e.g., 60-90-180-270-360 days).

All plans are billed in advance and are non-transferable. The duration of the plan begins immediately upon payment confirmation.

2. No Refund Policy

Strict Policy All payments for pricing plans are final and non-refundable.

Because our service provides immediate access to publishing features and digital posting capabilities, we do not offer refunds, credits, or partial refunds for unused portions of a plan, regardless of the circumstances (including, but not limited to, user inactivity, early cancellation, or changes in business needs).

By purchasing a plan, you explicitly acknowledge and accept this No Refund Policy.

3. Age Restriction & Verification (18+)

18+ Only Access to the Platform, including viewing and publishing advertisements, is restricted to individuals aged 18 years or older.

By using GlobyClassifieds, you represent and warrant that you are at least 18 years of age. The Platform may request age confirmation through various verification mechanisms.

Age Verification Process:

Users may be prompted to confirm their age (18+) before accessing certain content or publishing advertisements.
All advertisements that are categorized or flagged as 18+ content are displayed with a photo-stub overlay (age-gate) and a mandatory prompt requesting the user to confirm that they are 18 years or older before viewing the full content.
This age-gate mechanism is designed to restrict access to age-restricted material and protect minors.

Important Disclaimer: GlobyClassifieds relies on the accuracy of the information provided by users. We do not bear any responsibility for false, inaccurate, or misleading age declarations provided by users. It is the sole responsibility of each user to truthfully confirm their age. The Platform does not independently verify the actual age of users beyond the information provided during the confirmation process.

Users who are found to have misrepresented their age may have their accounts terminated immediately without refund.

4. Prohibited Items & Content

The following categories of goods, services, and content are strictly prohibited on GlobyClassifieds. Any violation may result in immediate account suspension or termination without refund.

Banned The following items and activities are not permitted on the Platform:

Narcotics & illicit drugs
Weapons & firearms
Ammunition & explosives
Explosive substances & materials
Human organs & body parts
Counterfeit & forged documents
Counterfeit goods & counterfeit products
Stolen goods & property
Financial pyramids & Ponzi schemes
Fraudulent activities & scams
Sale of user accounts
Malware, viruses & malicious software
Phishing & spam content
Prescription drugs without authorization
Sanctions evasion & circumvention
Money laundering
Terrorism financing
Content exploiting children & minors
Human trafficking & forced labor
Illegal gambling & betting
Sexual violence & abusive materials
Hate speech & discrimination
Hazardous chemicals & toxic substances
Tobacco & nicotine (where prohibited)
Animals prohibited by law
Any goods violating local legislation

This list is non-exhaustive. GlobyClassifieds reserves the right to determine, at its sole discretion, whether content violates the spirit or letter of these prohibitions.

5. User Responsibility for Legal Compliance

Users are solely responsible for ensuring that their advertisements, products, and services comply with all applicable local, national, and international laws in the jurisdiction where the advertisement is published or viewed.

This includes, but is not limited to, compliance with:

Consumer protection and product safety regulations;
Data privacy and protection laws (e.g., GDPR, CCPA);
Import/export control and customs laws;
Advertising standards and truth-in-advertising requirements;
Licensing, permit, and tax obligations.

GlobyClassifieds does not provide legal advice. It is your obligation to seek independent legal counsel if you are unsure about the legality of your content in any relevant jurisdiction.

6. No Verification & Disclaimer of Liability

IMPORTANT DISCLAIMER: GlobyClassifieds does not verify the accuracy, legality, quality, safety, authenticity, or existence of any advertisement, product, service, or user on the Platform.

All transactions, communications, and interactions are conducted solely between buyers and sellers. The Website is not a party to any transaction and assumes no liability arising from the use of the platform, including but not limited to:

Non-delivery or misrepresentation of goods or services;
Disputes between users;
Loss, damage, or injury resulting from any transaction;
Fraud, scams, or counterfeit products.

Users are encouraged to exercise due diligence and caution when engaging with other members of the Platform.

7. No Guarantee of Success

GlobyClassifieds does not guarantee that your advertisements will generate views, clicks, inquiries, leads, or sales. Our service provides visibility and posting capabilities, but the performance and outcome of an ad depend on many factors outside our control, including market conditions, competition, and user engagement.

By subscribing to a pricing plan, you acknowledge that you are paying for access to the platform, not for a specific business result. We do not warrant that your ad will achieve any particular level of exposure or success.

8. Right to Remove, Edit, Suspend, or Delete

GlobyClassifieds reserves the right to remove, edit, suspend, or permanently delete any advertisement or account at its sole discretion and without prior notice if it believes, in its sole judgment, that the content violates these Terms, the Prohibited Items policy, or any applicable law.

This right may be exercised without liability to the user, and in such cases, no refund or compensation will be provided for any unused portion of a pricing plan.

We also reserve the right to cooperate fully with law enforcement authorities in investigating suspected illegal activity.

9. Indemnification

You agree to defend, indemnify, and hold harmless GlobyClassifieds, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the platform, your violation of these Terms, your violation of any applicable law, or your violation of any rights of another user or third party.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall GlobyClassifieds be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the platform.

Our total liability to you for any claims arising from these Terms or the platform shall not exceed the total amount you paid to us during the twelve (12) months prior to the event giving rise to the liability.

11. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Changes will become effective immediately upon posting. Your continued use of the platform after any changes constitutes your acceptance of the new Terms. It is your responsibility to review this page periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GlobyClassifieds operates, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of that jurisdiction.
